| | 优铠（上海）机械有限公司（以下简称优铠公司）是一家制造、销售优选锯产品的公司，该公司主张其享有“边测量边锯切”的技术秘密，李某某、周某等人从优铠公司离职后成立了上海路启机械有限公司（以下简称路启公司），并利用优铠公司的技术秘密制造、销售优选锯产品。寿光市鲁丽木业股份有限公司（以下简称鲁丽公司）使用优选锯产品亦构成侵权。二审中，根据当事人的申请，最高人民法院组织各方当事人进行现场勘验并进行技术比对。最高人民法院经审理认为，根据二审勘验的实验结果，被诉侵权产品的锯切方式和结果遵循了涉案技术秘密的工艺流程，并且实现了涉案技术秘密的技术效果，属于侵害技术秘密的行为，故撤销一审判决，判令路启公司停止侵权，赔偿经济损失及合理开支600万元。同时，针对鲁丽公司无正当理由毁损人民法院查封证据的行为，对鲁丽公司作出罚款决定。 |
