| | 上诉人田某某因与被上诉人涂某某离婚纠纷一案，不服庆城县人民法院（2013）庆城民初字第554号民事判决，向本院提出上诉。本院受理后，依法组成合议庭，公开开庭进行了审理。上诉人田某某与被上诉人涂某某均到庭参加了诉讼。本案现已审理终结。 |
| | 原审判决认定，2009年2月，田某某与涂某某经人介绍相识，同年4月22日（农历3月27）日未经登记举行仪式共同生活，2010年6月8日生男孩田某志，2010年7月29日在庆城县赤城乡人民政府登记领取结婚证。婚后共同生活期间，双方多次因生活琐事发生纠纷，且田某某经常外出不归。2011年9月田某某外出至今未归。为此，涂某某诉至法院要求判决准予离婚。 |
| | 原审法院审理认为，田某某与涂某某虽自愿登记结婚，但婚后双方不能正确对待家庭生活，多次因生活琐事发生纠纷，尤其是田某某于2011年9月外出至今不归，双方分居二年之久，夫妻关系已名存实亡，涂某某诉请判决准予离婚，应予支持。为有利于孩子的成长，婚生子由涂某某抚养为宜。离婚后，一方抚养的子女，另一方应负担必要的生活费和教育费的一部或全部。故田某某应承担必要的抚养费，承担抚养费的数额可依据庆阳市2012年度农民人均纯收入4262.4元的标准，按月总收入30％的比例给付。涂某某要求田某某偿还家庭债务，但无证据证实，不予支持。审理中，涂某某放弃了个人财产，这是公民对其民事权利的处分，应予准许。遂依据《中华人民共和国婚姻法》第三十二条第二款，第三款第（四）项、第（五）项；第三十六条；第三十七条之规定，判决：1．准予涂某某与田某某离婚；2．男孩田某志随其母涂某某生活，其父田某某给付孩子抚养费18861.12元（4262.4元÷12月×30％×177月＝18861.12元），孩子独立生活后随父随母由其自选。限判决生效后10日内履行完毕。如果未按判决指定的期间履行给付金钱的义务，应当依照《中华人民共和国民事诉讼法》第二百五十三条之规定，加倍支付迟延期间的债务利息。案件受理费300元，由涂某某负担100元，田某某负担200元。 |
