 原审判决认定:杜某某之子杜某与李某之女李某粉经他人介绍于2013年农历十二月二十八订婚,杜某某向李某、马某某支付彩礼95400元。 2014年农历一月十六,双方子女未进行结婚登记,即举行婚礼同居生活。当时李某为其女陪嫁金耳环1对,电动三轮摩托车1辆,42英寸“中信”彩电1台(现均在杜某某家放置)。同居后,2014年3月,杜某与李某粉因生活琐事发生矛盾,李某粉即独自去天津务工与杜某分居生活至今。现杜某某诉至法院,请求返还彩礼95400元及折衣款8000元。
