(1) Basic Facts (一)基本案情
Around 03:00 on the early morning of March 3, 2006, the victim, Liu Weizhou, was robbed by offenders, including Su Futang, Wu Liqiang, and Tong Bin, when he was passing by the gate of the savings office of the Agricultural Bank of China (“ABC”) in Boyang Road, Maiji District, Tianshui City, Gansu Province. After being stabbed, Liu Weizhou cried for help. After hearing the call for help, the self-employed driver surnamed Hu and the manager of a beauty center surnamed Liang successively called “110” by mobile phone around 04:02, 04:13, and 04:20. The police officer on duty of “110” told them to call “120” and the operator on duty of “120” told them to call “110.” After Liang called “110” again around 04:24:20 (with a duration of 79 seconds), the police officer on duty of “110” instructed the local police station of Qiaonan to dispatch police officers by telephone on 06:23:35. At that time, the victim, Liu Weizhou, has died due to excessive loss of blood. It was found upon forensic analysis that the victim, Liu Weizhou, died from hemorrhagic shock after his femoral artery was pierced by other persons with sharp instruments. On March 23, 2007, the People's Court of Maiji District, Tianshui City rendered a criminal judgment (No. 4 [2007], First, Criminal Division, Maiji), in which it was determined that the police officer on duty of “110” of the Maiji Branch surnamed Gao committed a crime of neglect of duty and was exempted from criminal penalty. After Gao appealed, the court of second instance affirmed the original judgment. 2006年3月3日凌晨3时许,被害人刘某1路过甘肃省天水市麦积区桥南伯阳路农行储蓄所门前时,遭到罪犯苏某某吴某某佟某某的拦路抢劫。刘某1被刺伤后喊叫求救,个体司机胡某、美容中心经理梁某听到呼救后,先后用手机于4时02分、4时13分、4时20分三次拨打“110”电话报警,“110”值班人员让给“120”打电话,“120”让给“110”打电话。梁某于4时24分20秒(时长79秒)再次给“110”打电话报警后,“110”值班接警人员于6时23分35秒电话指令桥南派出所出警。此时被害人刘某1因失血过多已经死亡。经法医鉴定:被害人刘某1系被他人持锐器刺破股动脉,致XXX死亡。天水市麦积区人民法院于2007年3月23日作出(2007)麦刑初字第4号刑事判决,认定麦积分局“110”值班民警高某犯玩忽职守罪,免予刑事处罚。高某上诉后,二审维持原判。
...... 天水市中级人民法院作出(2006)天刑一初字第24号刑事附带民事判决,判决被告人苏某某吴某某佟某某赔偿刘某1相应的死亡赔偿金等。在民事判决执行中,因被告人苏某某已被执行死刑,无财产可供执行;被告人吴某某佟某某服刑前靠父母养活,暂无财产可供执行,天水市中级人民法院于2008年6月3日以(2008)天执字第29号民事裁定终结执行。被害人刘某1的近亲属张美华、刘某2刘某刘某3张某五人于2009年1月16日以公安机关行政不作为为由向天水市公安局麦积分局提出行政赔偿申请,该局作出不予行政赔偿的决定。张美华等五人遂以该局为被告,向法院提起行政赔偿诉讼,请求判令被告赔偿刘某1死亡赔偿金和丧葬费498640元,被扶养人生活费26959.95元。
