| | 马慧莲依据《中华人民共和国民事诉讼法》第二百零七条第一项、第二项的规定申请再审。主要事实和理由：(一)原审判决对案涉法律关系的性质认定错误。马慧莲在二审中提供了四组证据以证明马慧莲受孙铁红委托为其理财，马慧莲与孙铁红之间为委托代理关系，而非原审法院认定的借贷关系。第三人轮渡公司在二审中提供了其与孙铁红之间的《借款合同》《还款计划》《情况说明》等用以证明其与孙铁红之间是借贷关系。(二)原审法院认定基本事实错误。双方资金往来从2012年8月23日开始延续至2015年3月31日，期间马慧莲与孙铁红有几百笔资金往来。双方之间全部资金往来记录能够证明马慧莲不存在高达3838.3万元的债务，马慧莲在原审中多次提交双方发生的完整资金往来证据却未被采信。 |
