| | 农发行遂平支行申请再审称，本案应当依照《中华人民共和国民事诉讼法》第二百零七条第一项、第二项之规定再审。事实与理由：(一)韩艳丽、王忠抵押担保的贷款是借新还旧，用于偿还一加一公司原来的贷款，新贷与旧贷是同一笔贷款。(二)一加一公司与农发行遂平支行于2017年6月20日签订的41172801-2017年(遂平)字0026号《流动资金借款合同》(以下简称026号《借款合同》)，韩艳丽、王忠为该笔贷款提供了房产抵押担保，且均已办理抵押登记。(三)因中国农业发展银行贷款审批程序和贷款内部网络操作系统规则，办理抵押登记的借款合同、抵押合同与实际发放贷款的借款合同、抵押合同编号、金额不符，但并不能否认是同一笔贷款。(四)韩艳丽、王忠提供抵押担保的房产属于个人单独所有，没有共有人，办理抵押担保依法不需要配偶同意。(五)二审没有查明韩艳丽、王忠抵押担保的相关事实，认定事实错误。 |
