| Recently, the Chongming District People's Court of Shanghai (hereinafter referred to as the “Shanghai Chongming Court”) held an online public hearing on a criminal case involving illegal sale or purchase of precious and endangered species of wild animals. After nearly 1.5 hours' trial, the collegial panel handed down the first instance judgment in court that the defendant, Li, was sentenced to eight months' imprisonment and a fine of RMB 3,000 yuan for the crime of illegally selling precious and endangered species of wild animals, whereas another defendant, Lu, was sentenced to seven months' imprisonment with one year probation and a fine of RMB 2,000 yuan for the crime of illegally purchasing precious and endangered species of wild animals. | | 日前，上海市崇明区人民法院（以下简称“上海崇明法院”）对一起非法出售、收购珍贵、濒危野生动物犯罪案件进行在线公开庭审。经过近一个半小时的庭审，合议庭当庭作出一审判决，以非法出售珍贵、濒危野生动物罪判处被告人李某某有期徒刑八个月，并处罚金人民币3000元；以非法收购珍贵、濒危野生动物罪判处被告人鲁某有期徒刑七个月，缓刑一年，并处罚金人民币2000元。 |

| | 2019年间，被告人李某某在不具备驯养繁殖及经营利用资质的情况下，为牟取利益，经事先商议，分别于10月19日以人民币2300元、11月17日以人民币4000元的价格，将两只游隼出售给同样不具备上述资质的被告人鲁某。后被告人鲁某将上述游隼存放至其位于本市的一处办公室内。2019年11月30日，民警在上述地址查获涉案游隼。经鉴定，涉案游隼均系野生鸟类，为国家二级保护动物。 |
| | 公诉机关指控，被告人李某某非法出售国家二级保护动物游隼，被告人鲁某非法收购国家重点保护的珍贵、濒危野生动物，犯罪事实清楚、证据确实充分，分别应以非法出售珍贵、濒危野生动物罪，非法收购珍贵、濒危野生动物罪追究其刑事责任。 |
