| | 作为配送主管，魏某有着登录公司信息管理系统的权限，能看到所有客户信息。2018年4月至2019年8月间，魏某每天从系统内批量下载当天全市安装的新购小米彩电的客户信息，包含客户姓名、电视、住址等各类公民个人信息，并通过微信、百度网盘分享等方式发送给电视安装工王某，共计1.3万余条，王某则按月支付给魏某2000-3000元不等的报酬，共从中牟利3万余元。王某又将魏某发给他的客户信息倒手转卖给其他安装电视机的人，赚取差价。据王某称，安装电视机圈子里的人都想抢小米彩电客户单子，用来联系客户上门安装电视机赚钱。 |
| | 庭审中，王某和魏某均表示由于自己法律意识淡薄，一时贪念，没想到出售个人信息的后果原来这么严重，悔不当初。 |

| | 根据两高《关于办理侵犯公民个人信息刑事案件适用法律若干问题的解释》规定，将在履行职责或者提供服务过程中获得的公民个人信息出售或者提供给他人，违法所得2500元以上就属于“情节严重”。违法所得25000元以上的，可以认定为“情节特别严重”。 |
