| Nowadays, many cosmetic surgery institutions publish articles with photos of stars on WeChat as a marketing strategy of for drawing attention. However, use of other person's portrait for making profits without permission constitutes a civil tort, the tortfeasor shall pay the price for it. | | 发现自己的照片未经许可出现在了整形机构的微信公众号上，杨颖遂以肖像权、名誉权受侵犯为由将该微信公众号的主办者上海某医疗美容门诊部有限公司（以下简称医疗美容公司）诉至法院，请求判令医疗美容公司公开赔礼道歉；赔偿经济损失50万元、精神损失费5万元、维权成本等合理开支10万元。 |
| | 2016年6月28日，上海嘉定法院对此案进行公开开庭审理。庭审中，杨颖的诉讼代理人称，杨颖的肖像已经具有一定的商业代言价值。作为一名公众人物，杨颖一直以来都将维护个人健康形象作为工作的重点之一。涉案微信公众号的主办者未经杨颖允许擅将其肖像用于商业宣传，涉嫌侵犯杨颖的肖像权。同时，擅用杨颖肖像的位置，以及涉嫌侵权页面的内容，使得杨颖女士蒙受了很多误解，使其社会评价相应降低，医疗美容公司的行为同时涉嫌侵犯杨颖的名誉权。 |
