| [Case introduction] The Martial Soul Land was a fantasy novel created by Tangjia Sanshao (Zhang Wei). Zhang Wei exclusively licensed the right to adapt the novel for video games to Shanghai Xuanting Entertainment Information Technology Co., Ltd. (hereinafter referred to as the "Xuanting Company"). In the meantime, Zhang Wei created the Additions to Martial Soul Land: Legend of the God Realm. Chengdu Gamesky Co., Ltd. (hereinafter referred to as the "Gamesky Company") acquired the right to adapt the Additions to Martial Soul Land: Legend of the God Realm for video games by repeated sub-licensing. Gamesky Company then developed the video game software, New Martial Soul Land (Chapter God Realm), and signed with 4399 Network Co., Ltd. (hereinafter referred to as the "4399 Company") a profit sharing cooperation agreement, which explicitly stated that Gamesky Company was the copyright owner of the video game. Xuanting Company believed that Gamesky Company and 4399 Company infringed its right to adapt the case-related works, Martial Soul Land, without permission, and sued in the court. Both the courts of first and second instance held that as the case-related video game was a large video game, Xuanting Company would incur huge costs for the notarization of all chapters, undoubtedly increasing the difficulty of proof and the cost of rights enforcement for the right holder, contrary to the principles of fairness and efficiency. The video game and the novel were different manners of expressing works. In judging whether the two were substantially similar, not only the proportion of the number of words in the novel used in the video game, but also whether the originally expressed characters, relationships of characters, skills, storyline, and other elements of the novel were used should be taken into account, in addition to the proportion of original content of the novel in the video game. In judging the proportion of words used in the video game, the resource library files of the video game could be decompiled to assist in determining whether the video game used the original content of the written works. The video game developed by Gamesky Company, which made extensive use of the names of characters and souls, relationships of characters, skills, storyline, and other elements of the novel, Martial Soul Land, was substantially similar to the case-related novel, Martial Soul Land. Gamesky Company infringed the right of adaptation held by Xuanting Company by developing the case-related video game without the permission of Xuanting Company, and was thus adjudged to pay a total of 5 million yuan in compensation for losses and reasonable expenses. | | 【案情介绍】《斗罗大陆》系唐家三少（张威）创作的奇幻小说。张威将该小说的游戏改编权独家授予上海玄霆娱乐信息科技有限公司（以下简称玄霆公司）。同时，张威还创作了《斗罗大陆外传：神界传说》。成都吉乾科技有限公司（以下简称吉乾公司）通过多次转授权获得《斗罗大陆：神界传说》的游戏改编权。后吉乾公司开发了新斗罗大陆（神界篇）游戏软件，并与四三九九网络股份有限公司（以下简称四三九九公司）签订了分成合作协议，协议载明游戏的著作权人是吉乾公司。玄霆公司认为，吉乾公司、四三九九公司未经许可，侵害了其对涉案《斗罗大陆》作品的改编权，遂诉至法院。一审、二审法院均认为，涉案游戏属于大型游戏，如对所有章节进行公证，玄霆公司需要支出巨大成本，无疑增加了权利人的举证难度和维权成本，有违公平、效率原则。电子游戏与小说是不同的作品表达方式，判断二者是否构成实质性相似时，不能仅以游戏使用小说文字数量的比重进行判断，应综合判断其是否使用了小说中独创性表达的人物、人物关系、技能、故事情节等元素，并考虑小说中独创性的内容在游戏中所占比重。在判断游戏所使用文字的比重时，可以对游戏资源库文件反编译，以辅助确定游戏是否使用了文字作品中具有独创性的内容。吉乾公司开发的游戏大量使用了《斗罗大陆》小说中人物和魂兽名称、人物关系、技能和故事情节等元素，与涉案《斗罗大陆》小说构成实质性相似。吉乾公司未经玄霆公司许可开发涉案游戏，侵害了玄霆公司享有的改编权，故判决吉乾公司赔偿损失及合理费用共计500万元。 |
