The high people's courts, people's procuratorates, and education departments (commissions) of all provinces, autonomous regions, and municipalities directly under the Central Government; the Military Court and the Military Procuratorate of the People's Liberation Army; and the Production and Construction Corps Branch of the High People's Court of Xinjiang Uygur Autonomous Region and the People's Procuratorate and the Education Bureau of Xinjiang Production and Construction Corps: 各省、自治区、直辖市高级人民法院、人民检察院、教育厅(教委),解放军军事法院、军事检察院,新疆维吾尔自治区高级人民法院生产建设兵团分院、新疆生产建设兵团人民检察院、教育局:
For the purposes of strictly implementing the employment prohibition system for criminals, purifying the campus environment and protecting minors, in accordance with the Criminal Law, the Law on the Protection of Minors, the Teachers Law and other laws, and in consideration of the circumstances reflected in law enforcement and judicial practices, the Supreme People's Court have, in conjunction with the Supreme People's Procuratorate and the Ministry of Education, developed the Opinions on Implementing the Employment Prohibition System, which are hereby issued for your conscientious implementation in light of the actual circumstances. All problems encountered during the implementation shall be reported to the Supreme People's Court, the Supreme People's Procuratorate and the Ministry of Education respectively in a timely manner. 为严格执行犯罪人员从业禁止制度,净化校园环境,保护未成年人,根据刑法未成年人保护法教师法等法律规定,结合执法司法实践反映的情况,最高人民法院会同最高人民检察院、教育部制定了《关于落实从业禁止制度的意见》。现予以印发,请结合实际认真贯彻执行。在执行中遇到问题,请及时分别报告最高人民法院、最高人民检察院、教育部。

Opinions of the Supreme People's Court, the Supreme People's Procuratorate and the Ministry of Education on Implementing the Employment Prohibition System 最高人民法院 最高人民检察院 教育部关于落实从业禁止制度的意见
For the purposes of implementing the system of inquiring about the illegal and criminal records of faculty members in schools, kindergartens and other educational institutions and after-school training institutions, strictly implementing the employment prohibition system for criminals, purifying the campus environment and effectively protecting minors, the following opinions are hereby offered in accordance with the Criminal Law of the People's Republic of China (hereinafter referred to as the “Criminal Law”), the Law of the People's Republic of China on the Protection of Minors (hereinafter referred to as the “Law on the Protection of Minors”), and the Teachers Law of the People's Republic of China (hereinafter referred to as the “Teachers Law”) and other laws: 为贯彻落实学校、幼儿园等教育机构、校外培训机构教职员工违法犯罪记录查询制度,严格执行犯罪人员从业禁止制度,净化校园环境,切实保护未成年人,根据《中华人民共和国刑法》(以下简称《刑法》)、《中华人民共和国未成年人保护法》(以下简称《未成年人保护法》)、《中华人民共和国教师法》(以下简称《教师法》)等法律规定,提出如下意见:
I. In accordance with the provisions of Article 37 (I) of the Criminal Law, where a faculty member is given a criminal punishment due to a crime committed by him or her by taking advantage of his or her profession or a crime committed in violation of the specific obligations required by his or her profession, the people's court may prohibit him or her from engaging in the relevant profession for a certain period of time in light of the circumstances of the crime committed and the need for preventing the commission of any other crime. Where there are other prohibitive or restrictive provisions in any other law or administrative regulation on the faculty member's engagement in the relevant profession, such provisions shall prevail.   一、依照《刑法》三十七条之一的规定,教职员工利用职业便利实施犯罪,或者实施违背职业要求的特定义务的犯罪被判处刑罚的,人民法院可以根据犯罪情况和预防再犯罪的需要,禁止其在一定期限内从事相关职业。其他法律、行政法规对其从事相关职业另有禁止或者限制性规定的,从其规定。
