Notice by the People's Bank of China, the China Banking and Insurance Regulatory Commission, the Ministry of Finance, the National Development and Reform Commission, the Ministry of Industry and Information Technology and the State Administration for Market Regulation of Further Increasing the Support for Deferment of Principal and Interest Repayments for Loans Granted to Micro and Small Enterprises 

中国人民银行、银保监会、财政部、发展改革委、工业和信息化部、市场监管总局关于进一步加大对小微企业贷款延期还本付息支持力度的通知

Since 2020, the People's Bank of China (“PBC”) and other departments have, in accordance with the decisions and arrangements made by the CPC Central Committee and the State Council, issued and implemented policy of phased deferment of principal and interest repayments for loans granted to micro, small and medium-sized enterprises, effectively easing the pressure on the capital turnover of micro, small and medium-sized enterprises. For the purposes of increasing the support for micro and small enterprises and other market participants, and thoroughly and effectively implementing a package of policies and continuation policies to stabilize the economy, banking financial institutions are encouraged to negotiate with enterprises on deferment of principal and interest repayments for the loans granted to micro and small enterprises which mature in the fourth quarter of 2022 in a market-oriented way. The relevant matters are hereby announced as follows: 2020年以来,按照党中央、国务院决策部署,人民银行等部门出台实施了中小微企业贷款阶段性延期还本付息政策,有效缓解了中小微企业资金周转压力。为进一步加大对小微企业等市场主体支持力度,深入落实好稳经济一揽子政策和接续政策,对于2022年第四季度到期的小微企业贷款,鼓励银行业金融机构按市场化原则与企业共同协商延期还本付息。现就有关事宜通知如下:
I. Adhering to the principle of being market-oriented and law-based, and vigorously supporting the deferment of principal and interest repayments for eligible micro and small enterprises 一、坚持市场化、法治化原则,积极支持符合条件的小微企业贷款延期还本付息
1. Determining in a reasonable manner the loan extension and repayment arrangements. As for loans provided to micro and small enterprises temporarily in distress due to the impact of the COVID-19 epidemic, which mature in the fourth quarter of 2022 (including loans provided to individual industrial and commercial households and micro and small enterprises for operating purposes, here and below), banking financial institutions are encouraged to negotiate with borrowers on the deferment of principal and interest repayments under the principle of being market-oriented, with interest on extended loans normally accrued and penalty interest waived. In principle, the deadline for principal and interest repayment may be extended to a date not later than June 30, 2023. All banking financial institutions shall, according to production cycles and capital recovery cycles, among others, of the borrowers, determine in a reasonable manner the maturity dates and interest settlement methods of the extended loans so as to avoid the centralized maturity.   (一)合理确定贷款延期及还款安排。对于2022年第四季度到期的、因新冠肺炎疫情影响暂时遇困的小微企业贷款(含个体工商户和小微企业主经营性贷款,下同),鼓励银行业金融机构与借款人按市场化原则共同协商延期还本付息,延期贷款正常计息,免收罚息。还本付息日期原则上最长可延至2023年6月30日。各银行业金融机构应根据借款人生产周期及资金回笼周期等,合理确定延期贷款的到期日及结息方式,避免集中到期。
2. Effectively implementing the provisions on the classification of risks of extended loans. All banking financial institutions shall adhere to substantive risk judgments and adjust credit management systems in a timely manner; and shall not lower the classification of loan risk simply because of the epidemic or affect credit records.   (二)落实好延期贷款风险分类规定。各银行业金融机构要坚持实质性风险判断,及时调整信贷管理系统,不单独因疫情因素下调贷款风险分类,不影响征信记录。
3. Establishing and improving the due diligence-based liability exemption system. All banking financial institutions shall improve the relevant provisions on due diligence-based liability exemption for deferment of principal and interest repayments for loans, enhance operability, and exempt grassroots credit personnel from all or part of the liabilities for the non-performing loans caused by the loan extension on the premise of effectively preventing moral hazards.   (三)建立健全尽职免责制度。各银行业金融机构要完善贷款延期还本付息相关尽职免责规定,增强可操作性,在有效防范道德风险的前提下,对基层信贷人员因办理贷款延期形成的不良贷款,免于全部或部分责任。
4. Improving the guarantee system arrangements in a timely manner. If an extended loan involves guarantee, the banking financial institution shall handle it through consultation with the enterprise and guarantor, among others, and effective guarantee arrangements shall be maintained or alternative arrangements shall be provided under commercial principles.   (四)及时完善担保制度安排。延期贷款涉及担保的,各银行业金融机构与企业、担保人等协商处理,根据商业原则保持有效担保安排或提供替代安排。
