| For the purposes of ensuring the implementation of the amended Patent Law and responding to the urgent needs of innovation entities for the examination of partial designs and right of domestic priority of designs, the China National Intellectual Property Administration (CNIPA) has revised the Interim Measures for Handling Relevant Examination after the Implementation of the Amended Patent Law, which are hereby issued, and shall come into force on January 11, 2023. | | 为保障修改后专利法的施行，回应创新主体对局部外观设计、外观设计本国优先权的迫切审查需求，国家知识产权局修订《关于施行修改后专利法的相关审查业务处理暂行办法》，现予发布，自2023年1月11日起施行。 |

| Interim Measures for Handling Relevant Examination after the Implementation of the Amended Patent Law | | 关于施行修改后专利法的相关审查业务处理暂行办法 |
| Article 1 Beginning on June 1, 2021 (including the day, here and below), a patent applicant may file a design patent application for a portion of a product requiring protection in a written or electronic form in accordance with paragraph 4 of Article 2 of the Patent Law. | | 第一条 专利申请人自2021年6月1日（含该日，下同）起，可以通过纸件形式或电子形式，依照专利法第二条第四款提交请求保护产品的局部的外观设计专利申请。 |
| Where an application for a partial design patent is filed, a view of the entirety of the product shall be submitted, and the content requiring protection shall be indicated by a combination of solid and dotted lines or by any other means, and if the portion requiring protection includes a three-dimensional shape, the view submitted shall include a space diagram in which that portion is clearly shown. If the content requiring protection is not indicated by a combination of solid and dotted lines in the view of the entirety of the product, the portion requiring protection shall be indicated in the brief explanation. | | 申请局部外观设计专利的，应当提交整体产品的视图，并用虚实线相结合或者其他方式表明所需要保护的内容，要求保护的局部包含立体形状的，提交的视图中应当包括能清楚显示该局部的立体图；未在整体产品的视图中用虚实线相结合方式表明所需要保护的内容的，应当在简要说明中写明请求保护的局部。 |
| Article 2 From the date when these Measures come into force, for a patent application filed after June 1, 2021, if the applicant believes that it falls under the circumstance set forth in subparagraph (1) of Article 24 of the Patent Law, it may file a request in a written or electronic form. The CNIPA shall examine the aforesaid application after the amended Detailed Rules for the Implementation of the Patent Law come into force. | | 第二条 自本办法施行之日起，对于申请日为2021年6月1日后的专利申请，申请人认为存在专利法第二十四条第一项规定情形的，可以通过纸件形式或电子形式提出请求。国家知识产权局将在新修改的专利法实施细则施行后对上述申请进行审查。 |
| Article 3 For a design patent application filed after June 1, 2021, the applicant may submit a written declaration claiming the right of domestic priority for the design patent in accordance with paragraph 2 of Article 29 of the Patent Law. | | 第三条 对于申请日为2021年6月1日后的外观设计专利申请，申请人可以依照专利法第二十九条第二款提交请求外观设计专利本国优先权的书面声明。 |
