| Article 1 This Law is formulated in accordance with the Constitution for the purposes of improving the organization and working system of the State Council, and safeguarding and regulating the State Council's exercise of functions and powers. | | 第一条 为了健全国务院的组织和工作制度，保障和规范国务院行使职权，根据宪法，制定本法。 |
| Article 2 The State Council of the People's Republic of China, namely, the Central People's Government, is the executive organ of the highest state organ of power and the highest state administrative organ. | | 第二条 中华人民共和国国务院，即中央人民政府，是最高国家权力机关的执行机关，是最高国家行政机关。 |
| Article 3 The State Council shall uphold the leadership of the Communist Party of China, follow the guidance of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory, the important thought of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, resolutely uphold the authority and centralized and unified leadership of the CPC Central Committee, resolutely implement the decisions and arrangements made by the CPC Central Committee, carry out the new development philosophy, adhere to law-based administration, and fully and correctly perform government functions in accordance with the Constitution and laws. | | 第三条 国务院坚持中国共产党的领导，坚持以马克思列宁主义、毛泽东思想、邓小平理论、“三个代表”重要思想、科学发展观、习近平新时代中国特色社会主义思想为指导，坚决维护党中央权威和集中统一领导，坚决贯彻落实党中央决策部署，贯彻新发展理念，坚持依法行政，依照宪法和法律规定，全面正确履行政府职能。 |
